The grieving father of a young man who died in a DWI accident has filed a lawsuit against the property that failed to detect the signs of drunkenness in their patron
The father of Xavier Anderson, the young man who was killed in a fatal DWI accident in 2024, has now filed a lawsuit against the property he alleges overserved Emily Davis, 25, who crashed into the victim and killed him.
New Lawsuit Targets Property That Served Drinks to Guilty Driver
Davis was eventually sentenced to 10 years in state prison, serving out a Class B Felony, but the victim’s father has now gone after the casino, alleging that it had purposefully overserved the young woman.
Anderson has filed his lawsuit with Platte County Circuit Court, and is seeking $25,000 in damages for emotional distress, mental anguish, suffering, and medical and funeral expenses, as well as court costs, alleging that the Argosy Casino & Hotel in Riverside, Missouri, and its landlord, were negligent when overserving Davis.
The lawsuit cites three counts of negligence as well as carelessness and has not yet been commented on by the casino. The lawsuit also names PENN Entertainment Inc., GLP Capital, Gaming and Leisure Properties, and Missouri Gaming Company.
According to evidence provided during Davis’s trial, she was served alcohol between 10 pm and 2 am and then allowed to leave the property at 5 am. Anderson argues that the staff should have known better than to leave Davis driving under the influence.
Anderson’s lawyer, Lee R. Hardee III, spoke to the Kansas City Star and said that the plaintiff would seek full accountability from the property.
