The family of a three-year-old at the time of the accident has filed a lawsuit against gaming and hospitality over alleged negligence
An accident dating back to 2023 has come back to haunt Wynn Resorts. Several years back, a family from Utah was visiting Wynn Las Vegas when the family’s youngest child, then three, almost ended up drowning in the resort’s swimming pool.
The family of Wyatt Stanley, represented by Joseph III, Kelseigh, Joseph IV, and Jane, has filed a lawsuit with the Clark County District Court. The lawsuit alleges that Wynn demonstrated gross negligence, negligent hiring, training, retention, and supervision, and negligent infliction of emotional distress.

The lawsuit seeks a trial and general, compensatory, special, and punitive damages in excess of $15,000, as per the original filing. The plaintiffs also want the defendant to cover attorney fees.
Stanley ended up nearly drowning in the Encore swimming pool and was resuscitated only after his father rescued him from the pool, and a doctor and a National Football League coach happened to be there, and were able to render life-saving aid.
The company has acknowledged the filing in a statement and said that it was prepared to address it in court and present a full airing of “the facts.” The family alleges that Wyatt was allowed to enter the pool through the shallow side but ended up underwater shortly after.
His father was quick to react and pull him out. “Numerous individuals within the near vicinity, including a vacationing doctor and a professional football coach, began rendering aid and life-saving measures and CPR on Wyatt after defendant’s employees were incapable and/or unsuccessful in doing so,” the lawsuit alleges, pointing out that the employees on-site were not able to render the help needed to the child at the time of the accident.
Physician and NFL Coach Come to Boy’s Rescue
The real heroes, however, were Andrew Oleksyn, who is a physician, and Atlanta Falcons head coach Raheem Morris, who happened to be on-site when the accident happened. Oleksyn was with the Los Angeles Rams at the time and several weeks prior to the accident had received CPR training, which proved helpful in this case.
The family already publicized its case in the past, appearing on Good Morning America only several days after the incident took place. Wyatt’s mother, Kalseigh Stanley, said that it was a miracle and her boy was alive.
